General Terms and Conditions (GTC)

1. Scope
These General Terms and Conditions (GTC) apply to all contracts, deliveries and services between 
Nixar – Hakan Altun, An der Trift 10, 63263 Neu-Isenburg, Germany 
(hereinafter “Provider”) and its customers. 
The provider only supplies businesses within the meaning of Section 14 of the German Civil Code (BGB) (B2B). Contracts with consumers (Section 13 of the German Civil Code) are not concluded.

2. Conclusion of contract
The presentation of the products on the website www.bykerem.com does not constitute a legally binding offer, but rather a non-binding invitation to place an order. 
By submitting the order, the customer submits a binding offer. The contract is only concluded upon the provider's written order confirmation or upon execution of the delivery.

3. Prices and payment
(1) All prices quoted are net prices and are exclusive of statutory VAT and shipping costs. 
(2) Payment can be made either in advance, via PayPal or credit card. 
(3) The provider reserves the right to exclude certain payment methods in individual cases.

4. Delivery and shipping
(1) Delivery will take place within approximately 1 week after order confirmation and receipt of payment, unless otherwise stated in the offer. 
(2) Shipping is via DHL or UPS. Shipping costs are shown separately during the ordering process. 
(3) Partial deliveries are permissible provided that they are reasonable for the customer.

5. Individualized products
(1) In the case of goods that are manufactured according to customer specifications or are clearly tailored to personal needs (e.g. textiles with embroidery or printing), cancellation or return is excluded. 
(2) The customer is obligated to check the data, logos, and templates submitted by him for copyright, trademark, and other third-party rights. The customer is solely liable for any infringements.

6. Retention of title
The goods remain the property of the seller until full payment has been made.

7. Warranty
(1) The statutory warranty rights for entrepreneurs apply. 
(2) Minor deviations in colour, shape, material or size due to technical reasons do not constitute a defect.

8. Liability
(1) The provider is liable without limitation for intent and gross negligence. 
(2) In the case of simple negligence, the provider shall only be liable for breaches of essential contractual obligations (cardinal obligations), but limited to foreseeable, contract-typical damages. 
(3) Any further liability is excluded.

9. Place of jurisdiction and applicable law
(1) The law of the Federal Republic of Germany shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. 
(2) The place of jurisdiction for all disputes arising from contractual relationships between the provider and the customer is the registered office of the provider, provided that the customer is a merchant.

10. Final provisions
Should individual provisions of these General Terms and Conditions be invalid or unenforceable or become invalid or unenforceable after the conclusion of the contract, the validity of the remaining provisions shall remain unaffected.
